A "separation" is when a couple decides to live apart from each other because the relationship has broken down. The couple may be married, or they may be unmarried but living together like a married couple in a common-law relationship.
The Divorce Act sets out rules about:
equalizing assets
child support when parents separate
spousal support following separtion
decision-making responsibility and parenting arrangements for child(ren) after separation
A "divorce" is when a court officially ends a marriage. Only legally married couples can divorce.
Under Canada's Constitution, the federal, provincial and territorial governments share responsibility for family law.
Provincial and territorial laws also have rules about child support, spousal support, and custody and parenting arrangements for children. These laws apply when an unmarried couple separates and when a married couple separates but does not apply for a divorce.

The law says that parents are responsible for financially supporting their dependent children. Dependent usually means until the child turns 18 and sometimes longer.
A parent can be a birth parent, a non-birth parent, an adoptive parent, and sometimes a step-parent.
Generally, child support is money paid by the parent that spends the least amount of time with the child to the parent who takes care of the child most of the time. It is used to help cover the costs of caring for the child.
Even if your child spends an equal amount of time with each parent, the parent with the higher income may still have to pay some child support.
Decision-making responsibility is the right to make major decisions about how to care for and raise your child. Decision-making responsibility used to be called custody.
Decision-making responsibility is not about who your child lives with or how much time your child spends with each of you. The time that a child spends in the care of a parent is called parenting time.
Parenting time used to be called access for the parent who didn't have any decision-making responsibility. Now, all parents usually have parenting time.
Separation is when you and your ex—you can either be married or common‑law—decide to live apart. If you’re married, being separated doesn’t mean your marriage has ended. A divorce is when a court officially ends your marriage.
